    Course Descriptions:

Session 1: Boundary Determinations in Alabama - Jeff Lucas (3.5 PDH):

Should you find yourself in court defending your map of survey or your opinion on the location of the property boundaries, what are the important issues to know and understand to make a boundary determination that will win in court? What are the evidence standards that will be applied, the standard of care for professional surveyors in court, and what is the criterion for boundary determinations? What are the appropriate boundary law principles and how are they applied to a boundary determination? Ultimately, much like a doctor or a lawyer, the retracement surveyor renders a professional opinion on where property boundaries are located. How can the surveyor know if that opinion is legally sound? This course is a study of boundary retracement theory with real-world case studies directly from Alabama case law to reinforce the theoretical concepts discussed.

Session 2: Alabama SPCS 2022 - Prof. Bill Hazelton (3.5 PDH)

Following the publication of the User Manual for the Alabama SPCS 2022, based on the SPCS 2022 beta version, together with the foundations for the legislation to authorize SPCS 2022 in Alabama, this workshop goes through the latest design, as well as how to use it. The User Manual contains a depth of information on not only the Alabama SPCS, but also those systems in adjacent states, some underlying theory, the information needed to implement the SPCS in software, and information needed to create new or temporary zones. In this presentation, the User Manual will be explained and ways to use it covered.

Session 3: Contracts with one hour of Ethics - Jeff Lucas (3.5 PDH)

This course covers the basics of contract law for professional services providers and attendees will walk away with a one-page “Letter of Engagement” that can be utilized for most professional service offerings. Verbal, written, express and implied contracts will be studied. Short form and long form contracts, pros and cons, will be discussed. Certifications, warranties and guarantees and how they apply to professional services will be examined. Liability and limiting liability through contract language will also be studied with sample contract clauses. In addition, this seminar includes ethical considerations in everyday practice. Real cases studies involving ethical issues for professional practitioners will be discussed and explored.

Session 4: Standards of Practice - Jason Bailey (4.0 PDH)

Description: We will discuss the purpose and scope of Standards of Practice (SOP). Why SOPs matter: public trust, liability, and professional integrity. We will go through case examples of SOP violations and the consequences of those actions. The discussion will also cover the different types of surveys and the accuracy requirements for field and office work, monumentation of corners, and the preparation of legal descriptions. Conflicts of interest and impartiality will be discussed as it pertains to SOP and the responsibilities to clients, the public, and other professionals.
